-As Judge Kontoe Reserves Ruling
The Judge of the Sixth Judicial Circuit Court, Judge Bioma Kontoe has reserved ruling in the Gardnersville Somalia Drive Road Construction in motion for summary judgment which grew out of a summary proceeding to recover possession of real property.

According to a legal memorandum filed by Cllr. Arthur Johnson who represented the interest of the management of Dai Nippon Construction Company (DNC), he resisted the respondent (KNZ) Corporation by ad thru its general manager Zein Jaffa. Also indicating that the court should decide whether or not it would be in the interest of justice to evict his client (Dai Nippon Construction) from the premises when the defendant (KNZ) who is lessor still has in his possession that he admitted to refund the movant’s money in the amount of USD117,000.
It can be recalled that the two companies entered into an agreement for a lease of a certain property which the sole intend was to house the (Dai Nippon Construction) staff while it carried out the Somalia Drive Road Construction in the Gardnersville area.
The agreement was signed by both parties on March 6, 2014 for the construction of the Somalia Drive Road as an effort to implement the US$50,000,000.00 Japanese Grant to the people of Liberia and that was the result of a bilateral grant agreement between the Liberian government and the people of Japan to pave the Gardnersville Road to a four lane.
Cllr Johnson explained that it would be justifiable to grant and give the (Dai Nippon Construction) reasonable time for the stay on the said premises based on the intent of the initial agreement between the parties.
Counter arguing for the motion for summary judgment, Cllr. Benedict Sannoh, who represented the interest of the KNZ argued that his client on April 1, 2014 subleased a piece of property locate o the Somalia Drive for a period of three years with an option to renew the lease upon expiration of the term among other things he noted.
Predicated up that, his client instituted an action in summary proceedings to recover possession of real property against the (Dai Nippon Construction).
Meanwhile, Judge Kontoe has reserved ruling after listening to the final argument on Tuesday November 21, 2017.
