A civil society organization, Patriotic Alliance of Liberia (PAL) said it is deeply worried over the delay in the run-off election as this would lead the country to constitutional crisis that is in sight.

PAL said it is with deep regret and it is absolutely disappointing to bring to public the clandestine political plot organized by the Liberty Party (LP) in collaboration with the ruling Unity Party (UP) that has the propensity to dampen the run-off election and hold the country hostage.

In a release issued Friday November `7, 2017 in Monrovia, the group executive director, Korva M. Jorgbor while he welcomed the Liberty Party and its collaborating parties to exercise their constitutional rights through the legal process, the nullification of the October 10, 2017 general and presidential elections by request of the LP will lead to a constitutional crisis.

“If the National Elections Commission (NEC) delays with the certification of the representative candidates-elect within their respective districts during the just ended elections it would render the national legislature incapacitated to functions on the second working Monday in January 2018. That is the House of Representatives will not be present for the regular session due to failure of the NEC to certificate the representatives-elect,” PAL observed in the release.

Quoting Article 32(a), he said “the Legislature shall assemble in regular section once a year on the second working Monday in January. He also mention that the Senate and the House of Representatives, both of which must pass on all legislation. The enacting of all legislation don by both the Senate and the House of Representatives of the Republic of Liberia in Legislature assembled. How will Article 29 be implemented when the house is incomplete? Note: NEC is the only institution has the statutory rights to certificate all elected officers at the National Legislature before been qualified to take seat for which such person was elected.

According to PAL, Article 64 of the Liberian Constitution is not clear on the present situation or circumstances that Liberians faced with alleged electoral mal-practices including irregularities or fraud; this issue will lead to constitutional crisis.

The release further alleged that the legal teams of both the Liberty Party and the Unity Party are currently involved the legal hearing (administrative hearing), with an intent to delay the run-off election which is counterproductive to both the democracy and the legal system. “Their actions have the propensity to derail or undermine the peace we are enjoying today.”

PAL pointed out that even in the face of such clandestine political plot, Liberians still have the conviction that the run-off election will be conducted before December 30, 2017 and either of the political parties (UP and CDC) will over all prevail at the ballot box.

“So, we are appealing to the Liberty Party and the ruling Unity Party to reconsider their decisions and drop the allegation or charges level against NEC in other to have a peaceful transfer of power to the newly democratically elected government,” PAL appealed in the release.
